Terms and Conditions – Atelier Zacari

1. Scope and Seller Information

These Terms and Conditions apply to all orders, contracts, and subscriptions placed or entered into through the Atelier Zacari online store.

Mandatory statutory consumer rights remain unaffected by these Terms and Conditions.

2. Products and Services

Atelier Zacari offers original illustrations and designs, as well as products created from them. These may include stationery, stickers, postcards, art prints, calendars, clothing, mugs, accessories, digital products, and other physical or digital items.

Certain products are manufactured only after an order has been placed, using external production and fulfillment partners through a print-on-demand service, and are shipped directly to customers.

Atelier Zacari also offers the Snail Mail Club as a recurring subscription, as well as individual Snail Mail editions.

The specific products, their features, and the available shipping destinations are described on the respective product pages and during checkout.

3. Formation of Contract

The presentation of products in the online store does not constitute a legally binding offer.

By completing the checkout process, the customer submits a binding order. A contract is formed when Atelier Zacari accepts the order or begins fulfilling it.

Subscriptions are additionally subject to the Subscription Cancellation Policy published in the online store.

These Terms and Conditions are made available to customers before they place an order and form part of the contract where properly incorporated.

4. Prices, Currencies, and Payment

The prices displayed in the online store at the time of purchase apply.

Depending on the country or market, prices may be displayed and charged in Swiss francs (CHF) or another currency available in the store.

Shipping costs and any other charges known before the order is placed are displayed during checkout. If shipping is expressly included in the product price, no additional shipping charges will apply.

Payment must be made using one of the payment methods offered at checkout.

Taxes, duties, and other price components are handled in accordance with applicable legal requirements and the information provided during checkout.

International deliveries may be subject to additional import duties, taxes, or customs clearance fees in the destination country. Unless these charges are expressly included in the price or collected by Atelier Zacari during checkout, they are the responsibility of the recipient, where permitted by law. Any potential additional import charges will be disclosed for the relevant products before the order is completed.

Import duties already included in the price or collected during checkout will not be charged again by Atelier Zacari. Any statutory declaration and payment obligations of Atelier Zacari remain unaffected.

Currency conversion by the customer's bank or payment provider may result in additional fees beyond Atelier Zacari's control.

5. Delivery and Shipping

Atelier Zacari ships to the countries and regions available for the respective product in the online store or at checkout.

Available shipping methods, shipping costs, and estimated delivery times are provided on the product page, shipping information page, or during checkout.

Snail Mail: Switzerland, Japan, and the USA

Snail Mail products, including individual editions and the Snail Mail Club, are shipped exclusively to Switzerland, Japan, and the USA. Shipping is included in the respective purchase price.

Each edition is usually shipped towards the end of the previous month so that it can arrive as close as possible to the beginning of its edition month. For example, the November edition is handed over to Swiss Post at the end of October.

Order deadlines and subscription terms are specified on the relevant product page and in the supplementary Subscription Cancellation Policy.

Estimated delivery times after dispatch are:

Snail Mail is shipped without tracking. The delivery times listed above are non-binding estimates. International shipments in particular may be delayed due to transportation or customs clearance procedures. Delivery on a specific date is not guaranteed.

If your Snail Mail has not arrived after the estimated delivery period, please contact me at hi@atelierzacari.ch. Your statutory rights in the event of non-delivery remain unaffected.

Other Products and Shipping Partners

Certain products may be manufactured and shipped directly by production and fulfillment partners such as Gelato or Printify. As a result, different products within the same order may be shipped separately and from different countries of production.

Unless expressly stated as binding, all indicated delivery times are estimates.

Customers are responsible for providing a complete and accurate shipping address. Any changes should be communicated to Atelier Zacari as early as possible. Once an order has been handed over to the shipping provider, changes may no longer be possible.

Mandatory statutory provisions concerning delivery, delivery periods, and the transfer of risk remain unaffected.

6. Order Cancellation

If you wish to cancel an order, please contact Atelier Zacari as soon as possible at hi@atelierzacari.ch.

Voluntary order cancellations cannot be guaranteed.

Once an order has been processed, shipped, or submitted to a production or fulfillment partner for manufacturing, cancellation may no longer be possible.

Statutory withdrawal rights, warranty rights, and consumer rights remain unaffected.

Subscriptions are additionally subject to the Subscription Cancellation Policy published in the online store.

7. Personalized Products

For products made to customer specifications or clearly personalized, customers are responsible for ensuring that all information provided during checkout is accurate.

Once production has started, changes may no longer be possible.

Personalized products or products made to customer specifications may be subject to statutory exceptions to the right of withdrawal.

Products manufactured through print-on-demand after an order is placed are not considered personalized solely because they are made to order.

8. Withdrawal, Returns, and Complaints

Withdrawal, returns, and complaints are additionally governed by the policy entitled "Returns, Withdrawal & Complaints" published in the online store.

For orders within Switzerland, Atelier Zacari does not offer a voluntary general right of return or exchange for products that are free from defects.

For consumers in countries where mandatory statutory withdrawal or return rights apply, these rights remain fully unaffected. This also applies to deliveries to Japan and the USA where the relevant mandatory provisions are applicable.

Consumers in Germany and Austria generally have a 14-day right of withdrawal for distance contracts, subject to statutory exceptions. Further details, the return address, information about return shipping costs, and the model withdrawal form can be found in the relevant withdrawal policy.

9. Snail Mail Club and Subscriptions

The Snail Mail Club is a monthly subscription with no minimum commitment period. It renews automatically every month until cancelled.

The first payment is charged immediately when the subscription is purchased. Subsequent subscription payments are charged automatically each month using the saved payment method.

The next billing date can be viewed in the customer's subscription management page.

Each payment covers one monthly edition. Payments and shipping take place at different times. As a result, another payment may be charged before the previous edition has been delivered.

Signup Deadline and First Edition

The 20th of each month is the signup deadline for the following month's Snail Mail edition.

Customers who subscribe on or before the 20th will receive the following month's edition. Subscriptions started on or after the 21st will begin with the edition for the month after next.

For example, someone who subscribes on October 20 will receive the November Snail Mail edition first. A subscription started on October 21 will begin with the December edition.

The signup deadline determines the first edition and is independent of the customer's individual monthly billing date.

Cancellation

Subscriptions can be cancelled at any time through the subscription management page. To avoid another automatic charge, cancellation must take place before the next billing date.

Any editions already paid for will still be shipped as scheduled, even after cancellation.

Orders that have already been placed are not automatically cancelled or refunded if the subscription is subsequently cancelled. Statutory withdrawal, cancellation, and consumer rights remain unaffected.

Shipping and Address Changes

Snail Mail editions are generally shipped towards the end of the previous month. For international subscriptions, the applicable postal transit times must also be taken into account.

Delivery on a specific calendar date is only guaranteed if expressly agreed.

Address changes must be communicated in good time before the next scheduled shipping date.

The Subscription Cancellation Policy published in the online store also applies.

Mandatory statutory consumer rights remain unaffected.

10. Digital Products

Digital products are subject to the usage and licensing terms stated in the respective product description.

Unless expressly stated otherwise, digital content is intended for personal use only and may not be reproduced, resold, shared, or used commercially without the express permission of Atelier Zacari.

Any applicable statutory provisions regarding the loss of the right of withdrawal for digital content remain reserved.

11. Copyright and Intellectual Property

All designs, illustrations, texts, photographs, graphics, and other creative content produced by Atelier Zacari are protected in accordance with applicable intellectual property laws.

Purchasing a product does not transfer any copyright or other intellectual property rights in the underlying design.

Reproduction, redistribution, modification, or commercial use without express permission is prohibited unless otherwise permitted by law.

Different licensing terms may apply to individual products. These will be specified in the respective product description.

12. Defects and Warranty

If a product arrives damaged, defective, or incorrect, please contact Atelier Zacari as soon as reasonably possible at hi@atelierzacari.ch. If possible, include your order number and photos showing the issue.

Statutory warranty rights and rights relating to defective products remain unaffected. The request to report an issue promptly or provide photographs does not impose any additional deadline limiting statutory claims.

Minor variations resulting from production processes or materials may occur, particularly in colours, print appearance, positioning, or material characteristics. This applies especially to handmade and print-on-demand products. Statutory rights relating to actual defects remain unaffected.

13. Liability

Atelier Zacari is liable in accordance with applicable legal provisions.

No limitation of liability applies where liability is mandatory under applicable law.

Atelier Zacari is not responsible for the content of external websites linked from the online store, to the extent permitted by law.

14. Privacy

Information about the collection and processing of personal data, as well as the use of service providers and technologies, can be found in the Privacy Policy published in the online store.

15. Governing Law and Jurisdiction

These Terms and Conditions are generally governed by Swiss law.

For contracts with consumers, mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected to the extent that such provisions apply under the relevant law.

The legally prescribed places of jurisdiction apply to consumers.

16. Changes to These Terms and Conditions

Atelier Zacari may amend these Terms and Conditions for future orders, particularly if its product offering or legal requirements change.

The version of the Terms and Conditions incorporated at the time the contract was concluded applies to the respective order. Changes to existing subscription contracts are governed by the agreed terms and applicable legal provisions.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
